Terms and Conditions of Trade

1. About us and these terms

This website, https://forplay.co.nz (the Site), is operated by (Forplay, we, us, our). These terms apply to your use of the Site and to any purchase you make from us. By using the Site or placing an order, you agree to these terms.

We may update these terms from time to time. The version published on the Site at the time you place an order is the version that applies to that order.

2. Age Restriction (R18)

This Site sells adult products and is strictly for adults. You must be at least 18 years of age to use this Site and place an order. By using the Site and placing an order, you confirm that you are at least 18 years of age. If we discover that you are under 18, we will cancel your order and refund any payment received.

3. Use of the Site

You may use the Site only for lawful purposes and for personal, non-commercial shopping. You must not interfere with the operation or security of the Site, attempt to gain unauthorised access to it, or use any automated tools to extract content or data from it.

4. Products, pricing and availability

All prices are in New Zealand dollars and include GST. Prices and product availability may change at any time without notice. If a price changes after you have placed an order but before we have accepted it, we will contact you before processing the order.

We take care to display products accurately, but colours and appearance may vary slightly depending on your screen. Occasionally a listing may contain an error in description, pricing or availability. We may correct errors and, where an error affects your order, we will contact you and offer the choice of confirming the order at the correct price or cancelling it for a full refund.

5. Orders and acceptance

All orders are subject to acceptance and availability. Your order is an offer to buy. We accept your order when we send you an order confirmation by email. We may decline an order for any reasonable cause, including suspected fraud, pricing errors or stock unavailability, in which case any payment received will be refunded.

6. Payment

Payment is processed securely at checkout by our third-party payment provider. We do not store your full card details. Payment must be received in full before an order is dispatched.

7. Delivery

We use third-party fulfilment and courier partners to pick, pack and deliver orders. Orders are shipped in plain, discreet packaging with no reference to the nature of the contents.

Delivery timeframes shown on the Site are estimates only. We will let you know if there is a significant delay. Risk in the products passes to you on delivery to your nominated address.

Please ensure your delivery details are correct at checkout. We are not responsible for orders shipped in good faith to an incorrectly entered address.

8. Returns, faults and refunds

Our products are intimate and personal in nature. For health and hygiene reasons, we do not accept change-of-mind returns on any product that has been opened, unsealed or used. This does not affect your rights under the Consumer Guarantees Act 1993 (CGA).

If a product is faulty, damaged in transit, or not what you ordered, contact us at hello@forplay.co.nz as soon as possible. To help us resolve the issue quickly, please include your order number and, where relevant, photographs of the product and packaging.

Where a product fails to comply with a CGA guarantee, we will put it right. For faults that can be remedied, we will offer a replacement or store credit. Where the failure is of a substantial character, or cannot be remedied, you may choose between a replacement or a full refund, as provided by the CGA.

Nothing in these terms is intended to limit or exclude your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

9. Our Liability

Nothing in these terms limits any rights or remedies you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, or any other rights that cannot lawfully be excluded.

Subject to the above, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Site, and our total liability in connection with any order is limited to the amount you paid for that order.

Products sold on this Site are intended for adult personal use. Always read and follow any instructions and safety information supplied with a product. Nothing on the Site is medical advice.

10. Intellectual property

All content on the Site, including text, images, product descriptions, logos and graphics, is owned by or licensed to us and our suppliers. You may not reproduce, distribute or use Site content for any commercial purpose without our prior written consent.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.

12. General

If any part of these terms is found to be unenforceable, the remainder continues in full force. A failure by us to enforce any right under these terms is not a waiver of that right. These terms are governed by the laws of New Zealand and you submit to the non-exclusive jurisdiction of the New Zealand courts.
